Acceptance. By accessing or using DepressionResource.org, you agree to these Terms of Use. If you do not agree, please do not use the site. You must be 18 years or older, or have the consent of a parent or guardian, to agree to these Terms.

Educational purpose. The site is for general education only. It is not medical advice and is not a substitute for evaluation by a licensed clinician. See the Medical Disclaimer.

Permitted use. You may use the site for personal, non-commercial educational purposes. You may share links to pages and quote short excerpts with attribution to DepressionResource.org.

Prohibited use

You agree not to:

  • Use the site in violation of any law.
  • Use the site to infringe the rights of others.
  • Disrupt the site's operation or attempt to access systems or data not intended for you.
  • Scrape, mirror, or republish substantial portions of the site without written permission.
  • Use the site to harass, threaten, or harm any person.
  • Misrepresent your identity in any communication with the site.
  • Use automated tools, including AI training pipelines, to ingest substantial portions of the site without written permission. Training of AI models on the site's content is not permitted without a license.

To the maximum extent allowed by law, shrinkMD Publishing Inc., the editor, contributors, and reviewers disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

Except where prohibited by law, including for gross negligence, willful misconduct, or personal injury where applicable, shrinkMD Publishing Inc. and its contributors are not liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to the use of the site. This includes loss of data, loss of profits, business interruption, and personal injury arising from reliance on site content.

In jurisdictions that do not permit the limitations above, the aggregate liability of shrinkMD Publishing Inc. shall not exceed one hundred U.S. dollars ($100).

Force majeure

Neither party is liable for any failure to perform caused by events beyond reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemic, internet or utility failure, or government action.

We may add, remove, or change features of the site at any time without notice. We may update content as clinical information changes. We may update these Terms. The current version is dated at the bottom of this page. Continued use after a change means you accept the updated Terms.

Termination

We may suspend or terminate your access to the site for any reason, including breach of these Terms.

Governing law and severability

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. Any dispute that cannot be informally resolved will be brought exclusively in the state or federal courts located in Pinellas County, Florida, and the parties consent to personal jurisdiction there. If any part of these Terms is held unenforceable, the remaining parts remain in effect.

Informal dispute resolution

Before filing any claim related to these Terms or the site, you agree to first contact support@depressionresource.org and allow 30 days for an informal resolution.

Please do not include medical history, symptoms, or other protected health information in email. Email is not a secure channel and is not monitored for clinical purposes.

Optional arbitration

Either party may, by written notice during the informal-resolution window, propose binding arbitration of the dispute under the AAA Commercial Arbitration Rules, seated in Pinellas County, Florida. If both parties agree in writing, arbitration replaces the court-venue provision below. No party is required to arbitrate. Class arbitration is not available.

California Civil Code § 1789.3 notice

California users are entitled to specific consumer rights notice. The Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs may be contacted in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.

DMCA agent

Copyright complaints under the Digital Millennium Copyright Act can be sent to our designated DMCA agent at support@depressionresource.org. Include the information required under 17 U.S.C. § 512(c)(3), including identification of the copyrighted work, the infringing material, your contact information, a good-faith statement, and a statement under penalty of perjury that you are authorized to act for the copyright owner.

Entire agreement

These Terms, together with the Medical Disclaimer, Privacy Policy, Cookie Policy, and Accessibility Statement, are the entire agreement between you and shrinkMD Publishing Inc. regarding the site.
